Class action settlement deadlines, and what happens if you miss one

Class action settlements run on firm dates: usually a deadline to file a claim, a deadline to exclude yourself (opt out), a deadline to object and a final approval hearing. The dates are in the official notice and on the settlement website. If you miss the claim deadline, your claim is usually rejected and you're still bound by the settlement, so put each date in your calendar with a reminder. This is general information, not legal advice.

  1. The claim deadline

The last day to submit a claim form, online or by mail.

Tip: File early rather than on the last day, and keep your confirmation.

  2. Mailed claims and the postmark

Paper claims usually have to be postmarked by the deadline.

Tip: Check the notice for the exact rule and mail your claim with time to spare.

  3. The opt-out deadline

The last day to exclude yourself if you want to keep your right to sue the company on your own.

Tip: If you opt out, you can't also file a claim in that settlement.

  4. The objection deadline

The last day to tell the court in writing why you disagree with the settlement.

Tip: Follow the notice's instructions. You can only object if you stay in the class.

  5. The final approval hearing

The hearing where the court decides whether to approve the settlement.

Tip: You don't need to attend to file a claim. The date can change, so check the official website. How class action settlements work

  6. If you miss the claim deadline

Late claims are usually rejected, and you're still bound by the settlement unless you opted out in time.

Tip: Some settlements accept late claims in limited cases, but don't count on it; ask the settlement administrator.

  7. Keep your details up to date

Payments can take months, and a new address or email can mean a missed payment.

Tip: Update your contact or payment details on the official website if they change.

  8. Settlement checks can expire

Paper checks often have to be cashed within a set time printed on the check.

Tip: Cash or deposit a settlement check as soon as it arrives.

  9. Keep all your dates in one place

Deadlines from different cases are easy to mix up.

Tip: Add each one to your calendar with reminders a week and a day before.

  10. Get reminders before each deadline

Owed Pro sends reminders 7 days and 1 day before each matching settlement closes.
